Court blocks mail access to mifepristone abortion pill

..... A federal appeals court on May 1 [2026] issued a ruling barring people form getting mifeprisotne abortion pills through the mail, a move that;'s expected to significantly limit abortion access in states where it has been banned.

The ruling by the U.S. 5th Circuit of Appeals based in New Orleans comes in response to a lawsuit brought by Louisianian over federal regulation allowing abortion providers to send mifepristone, one of two abortion pills through the mail. State Attorney General Liz Murill argued the regulation "had resulted in numerous illegal abortions in Louisiana" and "thousands in Medicaid bills for women harmed."
..... On May 1, [2026] a three-judge panel for the appellate court issued its ruling granting Murrill's request to block the federal rule from the Food and Drug administration that allowed the pill to be sent by mail.
..... "By ending the in-person dispensing requirement FDA opened the door for mifepristone to be remotely prescribed to Louisiana women," the judges wrote in an opinion. "the record shows that the policy now facilitates nearly 1,000 illegal abortions in Louisiana pr month. A decision in Louisiana's favor would redress this injury because mifepristone could no longer be remotely prescribed to Louisianans."
..... The judges note in their opinion that their ruling will have an impact across the country. The ruling will likely be appealed to the Supreme Court.

..... Mifepristone is one of two abortion pills. It is sued with the other, called misoprostol, to end pregnancy that is less than 70 days developed. Misoprostol is also used to treat other medical conditions.
..... According to Johns Hopkins Bloomberg School of Public Health, the drug was developed in France in the 1980s and is authorized in 96 countries.
..... FDA regulators first authorized mifepristone in 2000. Leading medical associations and health experts consider the drug to be safe than Tylenol and Viagra.

The mifepristone-misoprostol combination has become the most common method for abortion. The two-drug sequence accounts for over half of abortions in the United States.
..... Use pf medical abortion pills rose dramatically after the 2022 Supreme Court decision to overturn Roe v. Wade. According to the Guttmacher Institute, a leading research organization that advocates for reproductive health, pills were used in 53% of abortion in 2020.
..... That share rose to 63% of abortions in 2023. Part of the drug's increased use is attributed to a 2023 FDA rule allowing mifepristone to be dispensed by mail.
..... The appellate court judges moved to block access to the pill based on the argument hat the access by mail "injures Louisiana by undermining tits laws protecting unborn human life and also by causing it to spend Medicaid funds on emergency care for women harmed by mifepristone."

Judges in their opinion citied the state's evidence that it paid $92,000 in Medicaid cost for "two women who needed emergency are in 2025 from complications caused by out-of-state mifepristone" and a 2023 FDA label that said 2.9% to 4.6% of women prescribed mifepristone will require emergency care.
